General Terms and Conditions of Sale

1. Object
These General Terms and Conditions apply to all online bookings made with our institution using the Outil Régional de Com­mer­cial­i­sa­tion’ regional marketing tool (ORC) and to all electronic bookings made via our booking platform.

The Visitor confirms that they have read and understood these General Terms and Conditions. The Visitor must expressly agree to these General Terms and Conditions in order to proceed with their booking. The Visitor has the option to save and print these General Terms and Conditions. 

The website www​.bps22​.be and the content of the online booking management system are managed by the not-for-profit organ­i­sa­tion BPS22 Musée d’art de la Province de Hainaut, whose registered office is at Boulevard Solvay 22, 6000 Charleroi, Belgium and which is registered in the companies register under number 0409.750.962. 2. Offers
All our offers are devised in good faith and based on the information available. Maps, photos and illus­tra­tions are provided for information purposes only and are not con­trac­tu­al­ly binding. They may be subject to change before the booking is finalised. The Visitor authorises us to correct any obvious material errors in the information that we provide to them.

Tickets booked online may be printed at home (print at home) or presented in electronic form. In both cases, the document must be presented at the Museum’s reception desk in a clear and legible format (the QR codes must be easy to scan) and will be accepted as proof of booking.

3. Price
The prices shown at the time of booking constitute the total price of the service sold, including taxes, fees and other charges. Any additional charges are clearly stated before the service is booked.

The Visitor authorises us to correct any obvious pricing errors.

Prices are confirmed to the Visitor in the Museum’s commercial currency and are valid only for the period indicated on the booking platform. All bookings, regardless of the country in which they are made, are payable in the Museum’s local currency, unless otherwise specified on site. Unless otherwise stated on the booking platform, additional services are not included in the price.

4. Booking
The Visitor chooses the desired services from those shown on the ORC. They confirm that they have read and understood the type, purpose and booking terms and conditions of the services available on the booking tool and that they have requested and obtained all necessary and/​or additional information in order to make their booking in full knowledge of the facts. The Visitor is solely responsible for their choice of services and for ensuring that their chosen services meet their needs; we cannot be held liable in this regard. The booking is deemed approved by the Visitor upon completion of the booking process.

5. Booking Process
Bookings are made by the Visitor using the electronic booking form available online on the reservation tool. The booking is deemed made upon receipt of the booking form. Prior to making a booking, the Visitor undertakes to complete all the information required for the booking. The Visitor confirms that the information provided is true and accurate. Once the final choice of services to be booked has been made, the booking process comprises the following steps: entry of credit card details, in the event of a request for a guarantee or pre-payment, reading and acceptance of the General Terms and Conditions of Sale relating to the service(s) and, finally, con­fir­ma­tion of the booking by the Visitor.

Except where special conditions or prices apply, the Visitor provides their bank details as a guarantee for the booking by credit card or store card (Visa, Mastercard, American Express, Diners Club, etc., depending on the options offered by the Museum’s booking tool). Payment is taken at the Museum at the time of the visit. In the event of a no-show (booking not cancelled – visitor not present) for a booking guaranteed by credit card, the Institution may charge the Visitor a fixed com­pen­sa­tion fee equal to the booking amount. The Institution has chosen elloha​.com/​s​t​r​i​p​e.com to secure online credit card payments. The validity of the Visitor’s payment card is verified by stripe​.com.

6. Booking Con­fir­ma­tion
The booking tool acknowl­edges receipt of the Visitor’s booking and immediately sends an email to confirm it. The booking con­fir­ma­tion email provides a summary of the contract offer, services booked, prices, terms and conditions of sale relating to the rate selected and accepted by the Visitor, the booking date and the address to which the Visitor can submit any complaints.

7. Withdrawal and Can­cel­la­tion Rights
The terms and conditions of sale for the rate booked set out the procedures for cancelling and/​or changing a booking. In the event of withdrawal, bookings cancelled more than 5 working days before the start of the activity will be eligible for a 95% refund of the activity price. Bookings cancelled less than 5 working days before the start of the activity will not be eligible for a refund. 

There may be changes to the programme or opening hours due to reasons beyond our control. These changes will be announced on our website. In the event of can­cel­la­tion or a change of date and/​or venue, we will inform you in writing by email whenever possible. In the event of can­cel­la­tion, you will be reimbursed the cost of your tickets. In the case of post­pone­ment, you may ask for your tickets to be reimbursed by sending a written request to email hidden; JavaScript is required 48 hours before the event

The BPS22 Musée d’art de la Province de Hainaut cannot be held liable for any activities that are cancelled or postponed due to force majeure affecting the content of the activity or for any minor changes to programmes. 

The ticket holder must abide by the venue’s rules and use, whatever the exhibition or event. The BPS22 reserves the right to refuse admission to all or part of the Museum’s premises for safety reasons. We reserve the right to cancel any event or to refuse admission to the galleries due to exceptional cir­cum­stances or force majeure, including but not restricted to: special measures enforced by public authorities in the event of terrorist threats, epidemics, pandemics or adverse weather conditions or due to strikes, fire, flooding, staff sickness, etc. 

8. Use of the Services
The Institution will be obliged to ask any visitor whose behaviour is contrary to good conduct or public order to leave the premises without any com­pen­sa­tion and/​or reim­burse­ment where payment has already been made.

It should also be noted that any sound or visual recording is prohibited without prior written permission. Except in the areas where it is expressly prohibited, it is permitted to take photos for private use without a tripod, flash or other lighting equipment.

Smoking is strictly prohibited in the Museum, as is drinking or eating in the exhibition galleries. Likewise, animals are not allowed into the Museum, except for assistance dogs.

In order to prevent misuse, any loss of tickets or other issues relating to tickets must be reported by email to email hidden; JavaScript is required at least 48 hours before the day of the activity or visit.

The Museum has a cloakroom (coin-operated lockers) and folding chairs available free of charge. 

9. Com­plaints/After-Sales Service
Complaints relating to poor or non-existent provision of booked services must be sent to us in writing within eight days of the service use date, on pain of forfeiture. Complaints must be sent by email to email hidden; JavaScript is required. The BPS22 undertakes to respond to complaints within a reasonable time frame, provided accurate and clear contact details have been supplied.

10. Privacy
We collect your data in accordance with the General Data Protection Regulation (GDPR) (2016/679). Any personal data that you provide us with is necessary for the purpose of processing your booking and essential for managing and providing our services. To this end, your data may also be transferred to our partners, including the operator of the booking tool, elloha​.com, online payment service providers and service providers located in third party States. In particular during online payment, the payment service provider has to send the Visitor’s bank details to the Institution’s bank in order to complete the booking. We only work with partners that guarantee a level of protection in accordance with the principles set out in the GDPR. With your consent, we may also use your data to send you information about our cultural events by email or post. As a data subject (person whose data is collected), you have the right to access your data and to have it rectified or erased, as well as the right to object to your data being collected. 11. Agreement on Evidence
Entry of the required bank details and acceptance of these General Terms and Conditions and the booking form or request constitutes an electronic signature which has the same legal validity between the Parties as a handwritten signature. Electronic records stored in elloha.com’s IT systems will be kept under reasonable security conditions and considered as evidence of com­mu­ni­ca­tions, orders and/​or payments between the Parties. Visitors are informed that their IP address is stored when making a booking.

12. Force Majeure
Force majeure is understood to mean any event external to the Parties that is both unfore­see­able and insur­mount­able, preventing either the Visitor or the Institution from fulfilling all or part of the obligations set out in the contract. Cases of force majeure or unfore­see­able cir­cum­stances are those generally recognised by the jurispru­dence of the Belgian Courts and Tribunals. The Parties may not hold each other liable for any failure to carry out their obligations resulting from an event of force majeure. The Parties explicitly agree that force majeure will suspend their performance of their mutual obligations, and that each Party will bear the costs arising therefrom.

It should be noted that the Museum may require submission of an official document attesting to the force majeure event.

13. Settlement of Disputes
These General Terms and Conditions of Sale are governed by Belgian law, without prejudice to any mandatory protective provisions that apply in the consumer’s country of residence.

14. Entirety of the Agreement
These General Terms and Conditions of Sale, the terms and conditions of sale for the rate booked by the Visitor and the booking form or request express the entirety of the Parties’ obligations. No general or specific conditions stated by the Visitor may be included in these General Terms and Conditions. In decreasing order of priority, the documents con­sti­tut­ing the contractual commitments between the Parties are: the booking form or request (including the specific terms and conditions for the rate booked) and these General Terms and Conditions. In the event of any con­tra­dic­tion between the booking form and the General Terms and Conditions, the provisions that appear on the booking form will be the only ones applicable to the obligation in question. The Institution may change and/​or add to these Electronic General Terms and Conditions of Sale at any time. In this case, the Institution will post online the new version of the Electronic General Terms and Conditions of Sale. Once the new version of the Electronic General Terms and Conditions of Sale is online, it will auto­mat­i­cal­ly apply to all visitors.
